Matthew Franck scrutinizes the factual basis for the claim being touted by Harvard’s Einer Elhauge that Congress in the 1790s created three mandates similar to the mandates implementing the Patient Protection and Affordable Care Act (PPACA) healthcare overhaul.  The PPACA is the basis for the U.S. Department of Health and Human Services coercive “preventive services” mandate, which obliges religious employers violate their consciences and deeply-held religious identities by providing contraceptives, abortion-inducing drugs, and sterilization services.
